TERMS AND CONDITIONS FOR TIM MCIVOR PHOTOGRAPHY

Introduction:

Welcome to Tim McIvor Photography, a professional photography business dedicated to capturing the most beautiful moments of your life. We provide various photography services, including weddings, engagement, portrait, event, and commercial photography.

By using our services, you, the Client, agree to comply with these terms and conditions. Please read them carefully and contact us if you have any questions.

1. Booking and Payment:

To secure a booking, a non-refundable deposit of 30% of the total cost is required. The remaining balance must be paid no later than 14 days before the shoot date.

If payment is not received within the specified time, the booking may be canceled, and the deposit may not be refunded.

1. Cancellation Policy:

If you need to cancel a booking, please let us know as soon as possible. Cancellations made within 30 days of the shoot date will incur a cancellation fee of 50% of the total cost. Cancellations made within 14 days of the shoot date will incur a cancellation fee of 100% of the total cost.

In the event that we have to cancel a booking due to unforeseen circumstances, we will provide a full refund of any fees paid.

1. Rescheduling:

If you need to reschedule a shoot, please let us know as soon as possible. We will do our best to accommodate your new date and time, subject to availability.

1. Photography:

We will use our professional expertise to capture the best possible photos. However, we cannot guarantee that every photo will be to your satisfaction. We will provide a selection of edited images, and you may choose your favorites for further editing or printing.

We retain the copyright of all images and may use them for promotional purposes, unless otherwise agreed upon in writing. You may not use the images for commercial purposes without our permission.

By using our services, you, the Client, are given a license to use the photographs, floor plan or Matterport 3D Showcase model in connection with the real estate listing for which the photos or model were taken. Once the Client loses the listing, or the property is sold or rented, the license is no longer valid.

1. Liability:

We are not liable for any damage or loss of personal property during the shoot. You are responsible for your own safety and the safety of any children or pets during the shoot.

We are not liable for any injuries, damages, or losses caused by any actions taken by you, your guests, or any other parties during the shoot.

1. Privacy:

We will respect your privacy and only use your personal information for the purposes of providing our services to you. We will not disclose your personal information to any third party, unless required by law.

1. Force Majeure:

We are not liable for any delay or failure to perform our obligations under these terms and conditions if the delay or failure is caused by circumstances beyond our reasonable control, such as natural disasters, wars, or strikes.

1. Governing Law and Jurisdiction:

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction where the shoot is conducted. Any dispute arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

1. Changes to Terms and Conditions:

We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website.
